我国网络犯罪立法问题探究

Investigation into the Problems of Cyber Crime Legislation in China

网络作为一种新兴事物,为现代人与人之间的沟通、交流提供了传输的平台,随着计算机网络技术的逐步普及,网络犯罪的种类和数量也在逐年增加,并且在网络上实施的犯罪行为,已经严重危害了社会环境。然而我国刑法学界对计算机犯罪的研究起步较晚,虽然在新刑法中也规定了计算机犯罪的条款,但是由于刑法规范具有一定的滞后性,使得完善网络犯罪立法成为当下刑事立法的紧迫任务。

As a newly sprouted thing,the network can provide a transmission platform for modern people to communicate with each other.With the gradual popularization of computer network technology,the types and numbers of cyber crimes are increasing year by year,and such criminal behavior has badly harmed the social environment.However,the field of criminal law started its research on computer crimes relatively late,besides,even though the terms of computer crimes have been set in the new criminal law,the regulation still has a hysteretic nature,which makes the perfection of cyber crimes become an emergent task for criminal legislation.
