摘要
近年来,随着社会的发展和改革开放的进一步深入,人才流动频率加快。人事档案数量剧增,人事档案管理过程中暴露出的问题日益加剧。尤其是人事档案中重要材料被漏装、错装以及高级人才的重要档案材料被原单位擅自扣留的现象似乎呈上升趋势。导致这些现象的发生很大程度上是因为档案相对人对自己的人事档案无从知晓。因人事档案固有的管理体制和严格的保密制度,我国的人事档案仍披着一层神秘的面纱。本文试从法理角度来探讨档案相对人的知情权。期待对现行人事档案管理制度的改革有所裨益。
In recent years, with the development of society and reform and opening, talents flows fast. Personnel archives increase and the management of archives faces more and more problems, especially wrong packing and leakage of important materials, and important archive materials of advanced talents are detained without permission because relative persons dont know about their personnel archives. Due to the original archive management system and the strict confidentiality system, personnel archives are wearing a layer of mysterious veil. The present article explores the right to know of relative persons from the perspective of legal principles, aiming at improving the archive management system and reform.
