摘要
宅基地使用权设立本是一种民事行为,其设立采取有偿还是无偿方式本是权利人的自由。但由于历史原因,我国宅基地使用权制度采取了申请——审批的行政许可设立方式,并一直无偿使用,导致宅基地使用权设立行为被异化,既限制了集体和农民的土地权利,又造成了土地资源的严重浪费。在我国市场化、城市化进程加速的推动下,宅基地利用必须符合效率原则和城乡平等原则,应恢复宅基地使用权设立行为的私法性质,逐步推行宅基地使用权有偿使用制度,实现宅基地的市场化配置,从而保护农村土地资源以及维护集体和农民的土地权益。
Housing land use right is originally a civil rights with which to take paid or unpaid is freedom of the right owners. However, due to historical reasons, the system of housing land use right of China takes the way of application-approval administrative permission and the land has been free to use, leading the establishment of the system of housing land use right to alienation,which not only limits land rights of collectivity and peasant, but also causes a serious waste of land resources. As the market-oriented and urbanization process accelerated, the utilization of hous- ing land must be consistent with the efficiency principles and the principle of equality in urban and rural areas. We should improve current acts for establishment for housing land use right in terms of resuming the private law nature of acts for establishment housing land use right, gradually push ahead the compensated using system of housing land use right and achieve market allocation of housing land use right, so as to protect rural land resource and the the rights and interests on land of the collective and farmers.
