保险利益与保险标的关系浅析

通过保险利益学说的历史演进说明保险利益的本质内涵,结合我国现行保险法对保险标的规定和海事保险类别的分析,指出:保险利益是投保人与以权利为表彰的财产之间的关系,即投保人与权利之间所形成的保险法上的利益关系。而且,这种抽象的利益关系,即保险利益是真正的保险标的。

The author has explained the essential connotation of insurable interest through the historical evolution of insurable interest theory, analyzed the definition of insurance object and kinds of marine policy in the combination of China current insurance law, and pointed that insurable interest is the relationship between the insured and his property, the interest relationship in insurance law between the insured and his rights. That＇s to say, insurable interest is the real insurance object.
