加拿大对西北航道主权控制的法律依据分析 被引量：14

摘要 加拿大根据国家利益需求,依据"扇形原则"、"历史性权利"和"直线基线"等原则强化对西北航道的控制权。由于"扇形原则"不被世界普遍承认,加拿大采用"直线基线"方式对圈定的海域进行权利巩固,并以"历史性权利"作为补充和辅助,以巩固基于其它基础之上获得的权利。这种主张缺少法理依据和事实根据。
