试论WTO解决环境争端的特点及其策略——兼议金融危机下我国的应对

WTO's Features and Strategies in Solving Environment Disputes——Also on Our Reply in Current Financial Crisis

首先对WTO解决环境争端的特点进行分析;其次对其作策略分析,最后结论表明:处理贸易与环境的关系,现阶段仍需要充分借助争端解决机构的实践及其经验;但长远看,WTO体制内和体制外的具体制度安排,才是有效解决贸易与环境关系的最佳途径。

An analysis first focuses on the characteristics of WTO in solving environment disputes, then the strategies WTO uses. After that, it is concluded that the relation between trade and environment should be handled by making the full use of the practice and experiences of organizations in settling the dispute at present stage. But from the long - term perspectives, the concrete institutional arrangement both inside and outside WTO system is the best solution to the relation between trade and environment.
