摘要
从英国殖民统治时期开始,印度逐渐形成了一整套比较全面的环境管理制度。这些制度可以分为三个层次:国家宪法与发展计划中的有关环境规定属于最高层次的根本制度,中间层次的制度包括作为组织制度的环境行政机构、作为法律制度的环境法律法规与条例和作为司法制度的法院,最低层次的制度是有关环境的重要政策声明和发展项目。从中世纪以来,印度的环境一直在持续恶化,究其根源在于印度的环境管理存在制度性的障碍,不仅环境管理的制度设计、监督与执行方面存在问题,而且是国家的政治经济根本制度使然。
Since colonial period,India has developed a more comprehensive system of environmental management. From the perspective of institutional analysis,there are three tiers of institutions:the basic institution contains in Indian Constitution and all five-year plans,the middle institutions consist of environmental administrational agencies,environmental laws and regulations,and the activism of the Super Courts,the specific institutions include related environmental policies,statements and programms. However,since the medieval era,India's environment has been deteriorated,due to the institutional obstacles in Indian environmental management
