婚约解除之研究——以晋江婚约习俗为视角

Research into the renouncement of engagement——a case study of engagement custom in Jinjiang

在我国婚约乃一普遍存在的风俗习惯,由于我国法律对婚约相关问题没有做出明确的规定,导致因婚约引起的大量纠纷得不到解决。通过婚约之性质剖析、追溯其渊源以明确其功能,进而分析现今社会生活的需求与法律立法不足之间的相互矛盾以求改善法律第一步;再次具体分析婚约解除后彩礼及损害赔偿问题以期能完美立法,使法律应社会之需。

In our country, engagement is a common custom. Owing to the lack of written stipulations concerning engagement in our laws, a lot of disputes arising from engagement are not solved. This paper analyses the nature of engagement, retrace its origin and makes its function clear and on their basis analyses the mutual contradiction between the needs of social life in modern times and the lack of legislation so as to improve the present law. At last the paper gives detailed analysis of betrothal gifts and compensation for damage after renouncement of engagement.
