摘要
旅游单项委托是区别于组团旅游服务的一种新型服务方式。根据合同相对性原则的例外,单项委托合同中的受托旅行社处于隐名代理人的法律地位。基于旅行社的法律地位,受托旅行社承担依委托的指示处理事务和履行报告的义务;在旅游者人身和财产出现损害时承担过错责任;防止旅游者滞留境外,有权收取出境保证金;因旅游辅助服务者导致旅行社无法履行单项委托合同时,受托旅行社有权引入介入权。
The travel principal-agent service is one of the new kinds of travel service which differs from package tour service.In accordance with the exception of the contract privity principle,the consigned travel service subject to the travel principal-agent contract has the legal status as an unnamed principal.Therefore,the consigned travel service shall undertake the obligation of dealing with the travel-related matters in accordance with the instruction of the travelers and perform its reporting obligation;where the personal or property damage is caused to the travelers,the consigned travel service shall undertake the fault liability;in order to prevent the travelers from illegal immigration,the consigned travel service shall be entitled to collect the security deposit;where the consigned travel service fails to implement the travel principalagent contract because of the travel service supporting providers,it shall have the right of intervention to deal with the disputes.
