对累犯从重或加重处罚,乃世界各国刑法之通例.累犯从重或加重处罚的根据在于累犯的人身危险性大于初犯."行为中心论"的累犯处罚突出强调加重刑罚的份量,"行为人中心论"的累犯处罚突出刑罚的矫正、改善功能.我国刑法对累犯处罚应以初犯作为参照系的从重处罚.

A recidivist will be given an aggravated punishment beyond the maximum prescribe,which is the usual practices in the criminal law in the world. The aggravated punishment of basis of recidivism is that the personal degree of danger of recidivism is greater than that of the first offender. The recidivist of action center penalty principle puts emphasis on giving the recidivism aggravated punishment beyond the maximum prescribe, but the recidivist of actor center penalty principle puts emphasis＇on functions of correction and reform of punishment. The penalty of recidivism should be aggravated as a standard of the first offender in China.
