摘要
"敏感精神"所致的文风更多洋溢在贝卡里亚47章原版《论犯罪与刑罚》中,这使他恰不具有近代理性神话的自以为是的自信,却有刑事一体化意味的心灵逻辑倾向。贝卡里亚主张以"社会法"作为立场,但"自然法"或"神明启示"仍是其内心指引,故其几何学精神和敏感精神的自洽辩证统一,形成其主情论与主知论自发结合的非古典自然法学的思想。在他看来,普遍利益和幸福就不仅是"欲望"的实现,亦是神明启示与自然法所追求的"至善"的实现,是新的道德重建的尝试。故其功利观念不同于古代希腊化时期的快乐学派,也不同于其后边沁等功利主义学人。
