按照我国现行城镇企业职工基本养老保险制度,对个人缴费不足15年的参保人员不予发放基础养老金,这一规定存在缺陷,不仅限制了农民工的参保,同时也使已经参保的农民工仍然被排除在有效保障范围之外。为改变这一现状,应尽快修改相关制度规定,将个人缴费不足15年的职工纳入基础养老金发放范围,实行按缴费年限系数由参保地计发基础养老金的新机制,在社会保险法中规定职工参加基本养老保险的待遇保障办法,加快研究和制定新型城镇职工基本养老保险制度。

According to China＇s current endowment insurance system for urban staff, one cannot get basic pension if the accumulative period for personal pension payment is not as long as 15 years, which not only prevents migrant workers from taking part in the urban endowment insurance system, but also excludes many insured migrant workers from deserved pension security. To change the situation, the relevant systems and regulations should be revised as soon as possible. It includes coveting the working staff into the system who pays for endowment insurance for less than 15 years, introducing a new mechanism by which basic pension is distributed according to the coefficient of personal payment years, making a rule in social insurance law about basic endowment insurance security and taking steps to research and make a new endowment insurance system for the urban staff.
