摘要
船舶油污损害赔偿法律制度是海事法理论研究和实践中的难题。分析船舶油污损害赔偿法律制度的构成要件和特征,对我国船舶油污损害赔偿法律制度的现状和问题进行探讨,从立法和实践方面提出建设有中国特色的船舶油污损害赔偿法律制度势在必行。
Law system of compensation for ship oil pollution damage has been a difficul problem in research and practical application of maritime law.The paper analyzes the constitutive elements and characteristics of law system of compensation for ship oil pollution damage and then discusses the current situation and problems of the law.Finally suggestions are given about legislation and judicial practice of the law system of compensation for ship oil pollution damage with Chinese characteristics.
