摘要
通过对工程实践中存在大量的三方合同的背景和起源的分析,给出了三方合同的定义及相关内容,并与传统的双方合同进行比较,指出三方合同的特殊性,针对三方合同的特点,提出了在工程实践中执行三方合同的建议。
According to the analysis on the background and origin of tripartite indenture which exists in engineering practice largely,the definition and correlative content of tripartite indenture are put forward in this paper.And the tripartite indenture is in contrast with the conventional bothsides contract in order to indicate the particularity of tripartite indenture.Finally,the proposal for tripartite indenture＇s performance in engineering practice is put forward according to particularity of tripartite indenture.
