摘要
我国是一个老龄化程度超越社会经济发展阶段的国家,现已有1 000万离退休人员。在越来越庞大的离退休人员队伍中,在返聘、离退休待遇、事实劳动关系等相关问题上发生争议的情况正逐年增加。这其中离退休人员的权益能得到何种程度的实现,大多与其法律身份的认定有关。
