惩罚伦理的两种取向:主体间本位与主体本位 被引量:2

摘要 惩罚的政治伦理可以分为主体间本位与主体本位两种取向。从政治哲学的层面来看,惩罚理论中各种不同的学说之所以相互批判、冲突不断,乃是因为它们分属于这两种不同的伦理价值类型。以赔偿、报应、恢复为目的的惩罚观在道德论证上是以主体间性为本位的,而以阻遏和改造为目的的惩罚观在道德论证上是以主体性为本位的。
