摘要
21世纪是知识经济的时代,科学技术影响着社会的各个方面。专家证据(司法鉴定)在诉讼活动中的应用越来越多,其所发挥的作用越来越大,有时甚至起着决定性的作用。但是,必须防止其滥用。美国的专家证据制度完备,极具代表性。美国专家证据"可采性"制度对我国司法实践有极强的可借鉴性。
The 21st century is the era of knowledge economy,science and technology affects every aspect of society.The expert evidence is more applied to the lawsuit activities.Its function is becoming lager and larger,even plays a crucial role.But we should prevent its abuse.The system of expert evidence in the USA is perfect and representative.The admissibility system of expert evidence in the USA has the significance of reference and inspiration to China.
