摘要
根据现行的法律法规,我国非聘任制公务员对涉及本人的人事处理不服可以申请复核、申诉或再申诉,但无权提起行政诉讼。基于公务员基本人权的保障、行政机关依法行政的有效监督、和谐社会的构建,我国应把公务员的诉权写入正在修改的《行政诉讼法》。为此,对公务员诉权法律保障的可行性及其保障的范围进行探讨确有必要。
According to the current laws and regulations,China's civil servants of non-appointment system can apply for recheck,appeal or reappeal,but they have not the right of administative litigation if they refuse to accept the personnel punishment involving themselves.Based on the security of fundamental human rights,the effective supervision of administrative organ's administration by law and the construction of socialism harmonious society,we should write litigation right of civil servants in amended Administrative Litigation Law.So it is necessary to discuss the possibility and the scope of legal guarantee of litigation right of civil servants in China.
