共同犯罪中的纯正身份犯若干问题研究

无特定身份者能否成为纯正身份犯的共同实行犯,应区分特殊主体犯罪的实行行为的性质,予以不同对待。无身份者并非在任何情况下都可以与有身份者共同实施犯罪的实行行为。当有特殊身份者与无特殊身份者为共同实行犯时,应对无特定身份者按身份犯的共犯来定罪处罚。

Can the person without status become the standard status crime？ On this question,we should distinguish the nature of the implementation of behavior.The person without status cannot make implementation of behavior with the person who has status in any case.When the persons with status and without status make implementation of behavior,we should convict and punish the person without status as the accomplice of the status crime.
