关于制定《农村集体经济组织法》的思考——以四川省都江堰市的探索为例

Reflection on the Development of "Law of the Rural Collective Economic Organizations" in China:Case of Dujiangyan City,Sichuan Province

在我国涉及农村集体经济的法律法规中存在一个费解的现象,就是一方面明确了农村集体经济组织的法律地位和权利,但另一方面却未规定农村集体经济组织的定义、具体形式、如何成立、如何运作、如何管理、如何参与经济活动、法人地位等内容,以致现实中农村集体经济组织无名无实。为促进农村集体经济发展、保护农民集体利益、适应农村社会变革,当前需要制定出台《农村集体经济组织法》。

A puzzling phenomenon exists in China's laws and regulations relating to the rural collective economy,that is,on the one hand the rural collective economic organizations of the legal status and rights is clear and explicit,on the other hand,the definitions of the rural collective economic organizations,specific forms,how to set up ,how it works,how to manage,to participate in economic activities,and legal status are not stipulated,so that the rural collective economic organizations have neither real anonymous nor reality. To promote the rural collective economic development,to protect the collective interests of the farmers to adapt to the rural social change,the formulation of 'rural collective economic organization Act' is needed currently.
