摘要
从"守俸如井泉"到"清廉七笔账"的利益引导困局及从"剥皮实草"到"贪官枪毙"的严刑峻法困局,都说明由于各种原因的存在,教育和刑罚的防范职务犯罪功能没能最大限度、最大效果地发挥出来。高检院推行的人民监督员制度和河南高院的"新政"进行了以尊重和保障人民监督权为核心的制度建构来防范职务犯罪的发生。反思历史教训,汲取现实成功经验说明,必须尊重和保障人民的民主监督权利,建立"人本"职务犯罪防范体系。
The confusion in advantage leading and penal law reveals that the precautious function of job-related crimes of reminding and punishing does not bring into play completely for a certain reasons. The Supreme People's Proeuratorate takes a people supervisors system and the administrative reform of Henan Higher People' s Court takes a system construction focusing on the respect and guarantee of people's supervision are effective measures to precaution job-related crimes. Drawing from historical lessons and realistic successful experiences, the necessity to establish a system of preeantion job-related crimes based on "taking man as man".
