摘要
我国现实中时常发生业主与开发商之间关于车位、车库权属的纠纷。《物权法》第74条将约定方式作为判断车位、车库归属的依据,但是由于其理解上的困惑,仍然存在着发生纠纷的隐患。在规划的车位、车库可能属专有也可能属共有的情况下,应当借鉴台湾立法模式,对小区车位、车库的归属进行分类规制,正确处理车位、车库的归属问题。
The ascription of garage and parking lot causes the dispute between the house owners and land developers in China. Based on the parties' contract in terms of Article 74 of Property Law,the ascription of garage and parking lot is in hidden trouble since the explanation for the rules of Article 74 is bewildered. In the planning of the parking garage which may either be proprietary or be shared circumstances,Taiwan should be taken as a model of legislation——classification regulations of garage ownership——so as to properly handle the issue of ownership of the parking garage.
