以传统文化中道德和法治思想关系为研究对象,对从传统文化中汲取的优秀法治精神进行了深入研究,侧重研究汉语语境下法律思维的形成,就古代中国法治、德治思想以及向西方样本学习的内在关系进行了讨论。融合当代法学文化成果,将借鉴吸收西方先进法学文化与重新认识本国传统法学文化特点和习惯相结合研究,同时提出一些有益、鲜明、独到的建议。

This thesis analyzes the relationship between ethical thinking and legal thinking in traditional Chinese culture. It illustrates the excellent legal spirit drawn from traditional culture,focusing on the formation of legal thinking in Chinese context,and paying special attenion to the legal system in ancient China,the thought of rule of virtue and the study of the western samples. The thesis is a combination of the latest achievements of contemporary legal culture,which combines the advanced legal culture of the Western countries and the re-recognition of our national legal cultural characteristics. Lastly,it puts forward some useful suggestions with a distinctive and original point of view.
