我国现行法律对农村集体建设用地使用权流转做了诸多限制,但在市场经济下受利益驱使,农村建设用地流转隐形市场已普遍存在,其利弊共存,全国各地也在进行集体建设用地使用权流转的试点建设。针对农村集体建设用地使用权流转市场的现状与问题进行探讨,并提出有针对性的建议,可以解决这一矛盾局面和困境。

In current law of our country, there are many restrictions on the transfer of the using rights of rural collective construction land. However, driven by the interests of Market economy, a virtual market of transfer of rural collective construction land was wide spread. With its advantage and disadvantage, Trail operations of transfer of the using rights of rural collective construction land also conducted all over the country. Discussing the situation and problems of rural collective construction land＇s transfer of using rights, and giving pertinent suggestions, we can solve this contradictory and difficult situation.
