农民工劳动权益保护现状及对策

The Status Quo and Measures of Protection of Peasant Workers' Labor-related Rights and Interests

近年来农民工劳动权益纠纷不断,农民工的劳动权益保护问题逐渐成为全社会关注的焦点。农民工劳动权益包含劳动权、报酬权、职业安全保护权、社会保障权、休息权等基本权利,农民工劳动权益受损有农民工缺乏法律常识和维权意识等自身的原因,也有法律法规不完善、用人单位不守法、城乡分割的二元体制等社会原因。提出完善保护农民工劳动权益的法律法规,加大法律法规的执法及监察力度,深化二元户籍制度改革,提高农民工的基本素质等途径,切实保障农民工合法劳动权益,促进社会和谐发展。

In recent years,disputes over peasant workers＇ labor-related rights and interests have arisen one after another,which have gradually caused the protection of peasant workers＇ labor-related rights and interests to be a social focus.Peasant workers＇ labor-related rights include labor,wage,personal security,social security,rest,and so on.The status quo of the rights of theirs is respectively expounded.It is thought that damages to peasant workers＇ labor-related rights stemmed from both their lack of common knowledge of law and such social factors as incomplete laws and regulations,failure of employing units in observing law,the current dual system that separates urban areas from rural ones,failure of trade unions in playing their due part,and so on.In order to make secure peasant workers＇ legal rights and promote social progress in a harmonious way it is put forward that the laws and regulations aimed at protecting peasant workers＇ labor-related rights should be perfected;the power of enforcement and supervision of the given laws and regulations be strengthened;the current dual household registration system be deeply reformed;the peasant workers＇ quality in law be improved;and security measures be provided for trade unions to better protect the peasant workers＇ labor-related rights.
