对串通招投标行为的概念、表现形式和成立要件进行了理论分析,阐述了串通招投标行为的危害,结合我国现有法律规定,提出了规制这种不正当竞争行为的措施,以期维护公平有序的市场竞争秩序。

The paper has the theoretic analysis of the concept of the bid-rigging,its manifestation forms and the constituted requisites,illustrates the harmfulness of the bid-rigging behavior,and points out the measures to regulate the unfair competition behavior by combining with the current laws and regulation in China,so as to maintain the fair and orderly market competition.
