The Restrictions on Government Information Disclosure

《政府信息公开条例》的执行遇到很大的阻力,这是政府长期信息不透明下的惯性所致,也是因为对信息公开存有心结。从规范层面讲,这些阻力不是来自于对政府信息公开范围的不理解,而在于对信息不公开范围的错误解读,甚至是恶意解读。科学准确地界定对政府信息公开的限制,包括界定国家秘密、商业秘密、个人隐私、国家安全、公共安全、经济安全、社会稳定、工作秘密、内部资料等概念,是明确政府信息公开范围的首要之举。

The implementation of ＂The Regulations of Government Information Disclosure＂ encountered a lot of resistance, which is caused both by the inertia of long-term lack of transparency on the government information and by the worry of government information disclosure. From the normative level, these obstacles do not come from the misunderstand on the scope of government information disclosure, but from the wrong interpretation on the scope of the information which does not open, or even malicious interpretation. To make clear the scope of government information disclosure, the primary move is to define the restrictions on government information disclosure scientifically and accurately, which includes the definition of state secrets, commercial secrets, personal privacy, national security, public safety, economic security, social stability, the secret of work, internal information and so on.
