摘要
通过阐述劳动合同法的立法主旨是着重保护劳动者的合法权益,分析了劳资双方保护的平衡,劳动合同法适用范围的扩大,阐明了劳动合同法的溯及力问题。以便对新法实施后存续的劳动关系的相关问题(续订合同次数的计算、事实劳动关系、违约金、经济补偿金、赔偿金)有一个比较准确地把握。
By expounding that the legislative purport of Labor Contract Law is to emphatically protect the legal rights of the labor, this paper analyzes the balance of the protection between labor and capital and the enlargement of the application scope of Labor Contract Law. It elaborates the issue of retroactivity of Labor Contract Law (the calculation of the times of renewing a contract, factual work relations, penalty, economic compensation, indemnity) so that the related problems of labor relations after the implementation of the new law can be grasped accurately.
