摘要
2008年1月1日《劳动合同法》实施以来,离退休人员返聘现象备受各界关注,褒贬不一。在实际工作中,离退休人员接受用人单位聘用后在工作中权益受侵的案件日渐增多,矛盾日益突出。只有在劳动力权利大致平等条件的基础上,才可以引导国内劳动力市场的整体发展,促进社会的安定,营造和谐氛围。
After the law of companies preferred to hire those labor contract has been issued since Jan 1st, 2008, more and more retired employees. This phenomenon caused disputes. In practice the interests of these rehired employees in the work is easy to be invaded and the number of such type of cases is increasing. Only based on the equity of the labor rights, the level of the labor market will be improved entirely and the social stability will be promoted and the harmonious culture will be created.
