全球化背景下当代中国法制现代化的趋向呈现出自主性与多元性、开放性与互动性、反思性与整合性的特点。尽管中国法制现代化过程中也出现了一些消极的后果,但是,当代中国的法制仍然处在"现代化途中",理性、自由、民主意识远没有在我们的个体生存、公共生活、社会运行和制度安排中作为本质性的机理和规定性而扎根,只有继续弘扬法律理性精神,同时沿着反思理性的路径监控防范和及时解决可能出现的风险才能进一步推进中国的法制现代化。

Under the background of globalization, the trend of legal modernization in china takes on the characters of independence and diversity, openness and interaction, introspection and integration. Though there emerge some negative consequences during the process of legality modernization, modern China is still on its way to modernization, sense of rationality, freedom, and democracy are far from taking hold as essential mechanism and rule in individual existence, public life, social operation, and institutional arrangement. The modernization of legality in china will make progress only if we further carry on the spirit of rational law, supervise through introspection, and settle potential risks timely.
