论高利转贷罪的特征及其认定

On the Characteristics and Identification of the Crime of Tradnsferring Loan at High Interest

高利转贷罪是新《刑法》增设的罪名。本文从立法角度阐述了高利转贷罪的概念、特征；从司法角度论述了认定该罪与非罪的界限。

The crime of transferring loan at high interest means an action aiming at profiting by transferring loans, from which a large sum of money can be got illegally. This crime is a supplimented one in the new “Criminal Law”. The article exposes,from the making of law, the concept and the characteristics of the crime and also discusses the boundary about judgement of the crime or not,and the difference between the crime and the defrauding crime.
