图书出版者的产品责任风险及其防范

从国内外立法和司法判例来看,图书是产品责任法中的产品,图书出版者存在因出版的图书有缺陷而承担赔偿责任的风险。为此图书出版者必须树立产品责任意识,加强产品质量管理;签订好图书出版合同,学会利用出版合同规避产品责任风险;加强对图书出版的过程管理,注意保留相应的证据材料。

From the view of legislation and judicial jurisprudences abroad and home, book is the product of Product Liability Law. Book publisher takes liability if there are defects in any published books, so book publisher must establish the awareness of product liability, enhance the control of product quality; book publisher signs book publishing contracts correctly, learns to use publishing contracts to avoid the risk of product liability; and strengthens the process management of book publishing, pays attention to retaining the appropriate evidence.
