网络环境下版权限制刍议

Copyright Restriction under Internet Invironment

基于版权法对于版权人权益和公众使用者权益的平衡,文章从宪法规定的人权保护、经济的合理性和OA与CC实践发展三个方面论述了网络环境下的版权限制应呈适度加强趋向的理论依据和现实可能。

Based on the interests balance between the copyright owner＇ s rights and the public rights, the paper discusses the relationships of the copyright restriction with the three parts： the constitutional human rights protection, economical rationality and the practice developments of OA and CC, and it put forwards that under the network environment the copyright restriction should be appropriately strengthened.
