我国高校学生参与权的法律保障与救济

An Investigation on in Universities and Colleges the Right of Participation and its Guarantees and Redresses

学生参与管理既是高校民主自治的要求,也是学生成长和发展的制度保障。本文通过分析我国高校学生参与权现状,及对其产生原因的深入研究,对现存的校内申诉、教育行政机关申述、行政复议以及行政诉讼等渠道进行整合,提出建立校内申诉、行政复议、行政诉讼、国家赔偿相衔接的体制,同时通过完善校内信息公开制度、校园听证制度,以及构建国家宪法权利司法化救济制度和教育仲裁制度,以期为学生参与权的保障与救济提供有效救济。

Based on the current realities of China, the paper makes a deep investigation on cause and present conditions of the participation right in China. This study tends to integrate contemporary pleading on campus, administrative pleading, administrative reexamination, and administrative proceeding into one system. Further- more, it illustrates that the information disclosing system, the perjury system on campus, the redress of constitutional right in juridical aspects, and the arbitration system in university can provide efficient and comprehensive redress.
