摘要
按照契约理论的观点,独立学院可视为一系列相关资源者形成的契约网络,其中,母体高校和合作方之间签订的办学契约是主契约。本文通过一个案例分析讨论了办学契约的选择、权利安排以及契约执行情况,以此说明和解释独立学院组织的发生以及公办高校母体和合作方之间的关系问题。
According to the theory of contract,independent colleges can be regarded as a contract network of a series of related resources,in which the contract between public universities and the partners is a major one.This article discusses the choice of contracts,arrangement of rights and enforcement of the contracts by a case study,and in this way explores the forming of this new organization and its institutional default in design.
