摘要 近年来,我国劳务派遣现象逐渐普遍化,甚至成为一些用人单位常态的用工形式,损害被派遣劳动者合法权益的事例时有发生。虽然《劳动合同法》对劳务派遣作了专门规定,一定程度上促进了我国劳务派遣市场秩序的建立,但在规范劳务派遣用工的同时,也带来了一些负面影响。为应对这一问题,在分析劳务派遣行业快速发展的原因、存在问题的基础上,提出了完善被派遣劳动者权益保护的具体思路,以促进该行业的良性发展。 In recent years, the dispatch of labor services has become a general phenomenon in China, and has even become the normal form of employment for some units. However, the instances of aggression on legal fights and interests of dispatched laborers have occurred frequently. "Law on Employment Contracts" has made stipulation for the dispatch of labor services, which promotes the establishment of market order in the dispatch of labor services to some extent in China, standardizes the dispatch of labor services, but has some negative influences in the meanwhile. In order to deal with this issue, the paper analyses the reasons for rapid development and problems of dispatch of labor services, and puts forwards specific ideas to perfect rights and interests protection of dispatched laborers to promote its sound development.
