论横向垄断协议的规制

The Analysis of the Horizontal Agreement

横向垄断协议作为垄断协议的一种,对竞争损害最为直接和严重,各国均纷纷立法予以禁止。我国现行的《反垄断法》虽然规定了横向垄断协议,但关于横向垄断协议的法律责任、反垄断执法机构设置的规定存在不足之处。我国应该设置一个专门的独立的反垄断执法机构,规定横向垄断协议的经济法责任,实行对横向垄断协议的双罚制。

The horizontal agreement is one of the monopoly agreements.It＇s one of the most central system of Anti-Monopoly Law among different countries for it＇s bad damage in the market competition.China＇s＂anti-monopoly law＂pointed out horizontal agreement,but there are also shortcoming.This article put forward measures to perfect the system： set up a special independent authority of the anti-Monopoly law enforcement agencies,the introduction of foreign punitive damages system,the dual penalty system of horizontal agreements.
