摘要
环境损害的特点决定其需要特殊的救济制度。环境损害赔偿以补救既成的环境损害为目标,其制度设计应当以环境损害以及赔偿概念的界定为基础,明确环境损害赔偿的范围,形成民事赔偿、社会化赔偿和公共补偿等多种赔偿方式相协调的体系,并建立或者调整相应的程序制度。
The environment damage is different from other kinds of damage, so we ought to establish the special environmental tort legal system. The purpose of compensation for environmental damage law is to make range up for the environment damage. We should analyze the concept of environment damage, decide the of compensation and establish a statutory system including civil compensation system, socialized compensation system and common compensation system.
