荀子德法关系论

On the Relations between Virtue and Law in Xunzi

荀子的德治体系是以礼为核心,以法律为补充手段的治国方略。在德法关系的理论架构中,荀子吸取了法家之长,使儒家德治思想有了新的发展。文章通过德先法后、明德慎罚、德本法辅、德原法流、德隆法重等几种观点来阐释荀子德主法辅的思想本质。

The system of rule-by-virtue of Xunzi is a strategy to govern a country,whose core is ceremony and whose implement is the legal measures.Therefore in the theoretical structure between the relation of virtue and law,Xunzi absorbs the advantages of legalist school,and also contributes a lot to the development of Confucianism.This article tries to interpret the nature of Xunzi＇s ideas which have rule-by-virtue as the core and are complemented by legal means,namely,relations between virtue and law,with the former as primary,understandable,basic,original,and ceremonious,and the latter as secondary,cautious,complementary,consequential and important.
