摘要
"在家教育"在美国经历了发展、消失及重新发挥作用的阶段。美国法院就现代"在家教育"的合宪性作出了一系列的判例,主张"在家教育"权源自于美国《宪法》。各州教育法一方面承认"在家教育"的合法性,另一方面予以合理规制,在制度与实践上推动了美国"在家教育"的发展。
As an oldest education approach, home schooling in the USA has experienced the stage of evolution, disappearance, and revival. The U.S. courts adjudicated a series of cases of home schooling, and claimed the rights of home schooling were from the Constitution. At the same time, some states＇ education laws admitted the legitimacy of home schooling and enforced some regulations to it, which push forward the development of home schooling in system and practice.
