Path Choice for the Reform of Land Property and Its Transfer Policies

研究目的:探寻中国土地产权及其流转制度的改革的路径。研究方法:通过Williamson4个层次的分析框架,分析1949年以来农村和城市土地产权及其流转制度的变迁过程。研究结果:中国土地产权和流转制度的变迁,不仅是法律问题,还受到文化、治理、经济行为等因素的共同影响。研究结论:农村和城市内部的改革虽然在时序上不同,但它们在路径选择逻辑上的共性,可以为各自改革提供参考。

The purpose of this paper is to probe into the path for the reform of China＇s land property and its transfer policies. Method employed in this paper is to analyze the evolutional process of land property and its transfer policies in rural and urban areas of China since 1949 through the four-level-analysis framework of Williamson. The results indicate that the evolutions of China＇s land property and transfer policies are not only the issues of law, but also related to cultural, governance and economic behaviors, etc. Although the evolutions inside rural and urban sectors are separated in terms of time sequence, the common logic within their path-chosen progress could provide referential experiences both ways.
