Function of Public Participation Mechanism in City Demolition and Its Legislative Suggestions——Thoughts on Dilemma for New Regulations Making

公共利益的界定和补偿标准的确定是城市房屋征收与拆迁立法的两大难题。公众参与具有约束公权力、保障私权利之功能,是合理界定公共利益、确定补偿标准的有效途径。因此,将公众参与中的听证和协商机制引入"新《条例》",有助于走出城市房屋征收与拆迁的立法困境。

Since the definition of public interest and the determination of compensation standard, the two major puzzles in city house requisition and demolition legislation, can be solved by public participation mechanism which is of the functions of public power restriction and private power protection, it will be helpful for working out the legislation dilemma to introduce into the New Regulations the hearing and negotiation mechanisms of public participation mechanism.
