知识产权公共政策是发展中国家应对TRIPS挑战,促进经济技术发展的有效工具,制定符合本国国情和本国利益需要的知识产权公共政策对发展中国家至关重要。通过研究国际背景下知识产权公共政策复杂的、充满争论和不断发展变化的历史,分析TRIPS对发展中国家的不利影响,提出发展中国家应团结起来,反对更高标准的知识产权保护,最后就中国当前制定平衡有效的知识产权公共政策提出政策建议。

Intellectual property public policy is an efficient tool for developing countries to face the challenge of TRIPS and facilitate the economic and technological development. It is critical that developing countries should make intellectual property public policy which is correspondent with the domestic conditions and beneficial requirements. The paper focuses on studying the worldwide evaluation that is complicated, full of contest and continuingly changeable. The author analyses the disadvantage impacts caused by TRIPS to developing countries and suggests that developing countries shall cooperate and concentrate efforts on opposing the higher standard of intellectual property protection. Finally, the paper puts forward corresponding proposals in line with current Chinese intellectual property public policy which is balancing and efficient.
