网络言论自由的合理限制浅析——“人肉搜索”的宪法学思考

随着网络技术的发展,"人肉搜索"逐渐风靡网络,这种新型搜索引擎可以更为便捷而专业地解决求助者的问题,方便公众日常生活。然而其中更受关注的身份确认型"人肉搜索"却因与当事人相关人身权利的冲突而备受争议。文章试图从宪法学角度,对身份确认型"人肉搜索"进行分析,明确其中言论自由权与隐私权等人身权利的冲突,从而对其进行合理规制,以期引导其进入良性发展轨道。

With the development of network technology,human-powered search increasingly become popular on the network,this kind of new search engine can solve the problem more easily and professional.While the identical type human-powered search is controversial as in conflict with some personal rights of parties.This article tries to analyze the identical type human-powered search from the perspective of constitution,to clear the conflict between the freedom of speech and privacy,and then restrict it reasonably,with the hope that the human-powered search can develop well.
