摘要
20世纪90年代初,为推动我国竞技体育职业化,原国家体委以足球为突破口,建立了以足球俱乐部为代表的各类职业俱乐部。但作为具有特殊性质的主体,我国的体育俱乐部建立和运营一直缺乏相应法律法规,尚未健全类似公司法人治理结构的管理机制和运营模式,这就导致俱乐部在运营中出现较多纠纷,特别是法律纠纷。本文拟从法律角度看待这些体育俱乐部所存在的问题,并提出自己的解决思路。
In the early 1990s,in order to promote the professionalization of China＇s competitive sports,the Physical Culture and Sports Commission of the PRC set up various professional clubs on behalf of football club which took football as a breakthrough.But as a special main body,the establishment and operation of sports clubs lack of corresponding laws and regulations,the management system and operation mode of the corporate governance structure are missing,which has led to more dissension especially those legal dissension occurred in the operation of clubs.This paper observes this issue of the sports club from the legal aspects and proposes some solutions.
