Causes of and Violent Law-enforcement Behaviors and Countermeasures

暴力执法现象是值得关注的社会问题,作为一种严重的行政违法行为,具有深厚的社会思想根源和客观的现实原因。暴力执法行为严重侵犯相对人的合法权益,违背法律的基本价值,损害法律的威信,扰乱社会秩序,破坏政府形象,阻碍法治和和谐社会的进程。转变执法理念、提高执法艺术、健全责任机制、加强相关立法,是控制暴力执法现象的有效对策。

Violent law-enforcement as a kind of social problem and a serious administrative illegal act attracts much social concern at present and it is caused by profound social ideological factors and objective reality. The violent law-enforcement behaviors result in serious harms including violation of the rights of the private party, destroying the basic value of the law, damage of the laws’ authority, disturbance of the social stability, spoilage of the government’s image, etc. Therefore, in this paper some effective strategies are suggested for elimination of this sort of phenomena.
