马克思主义法学理论是马克思主义理论的重要组成部分,在马克思主义中国化过程中,马克思主义法学理论也开始了中国化历程,形成了丰富的中国化的马克思主义法学理论成果。从马克思主义法学理论到中国化的马克思主义法学理论成果,存在着马克思主义法学理论中国化的路径问题。马克思主义法学理论中国化的路径与马克思主义中国化的路径是一致的,存在两个层面,一是马克思主义法学理论与中国具体实践相结合、走实践主导模式的实践层面,二是马克思主义法学理论与中国传统文化相结合、走文化扬弃的文化层面。

Marxist theory of law is an important component of Marxist theory. In the course of Chinese Marxism, Marxist theory of law in China has formed a rich storehouse of its fruits. Between Marxist theory of law and its rich fruits in China, there are ways and means by which Marxist theory of law has been employed to solve legal issues in China. Marxist theory of law has been applied to Chinese practice in the same way as Chinese Marxism. There exist two levels. One is the level of the practice - oriented model that Marxist theory of law is closely integrated with concrete Chinese practice. The other is the level of culture, i. e. Marxist theory of law has benn organically combined with traditional Chinese culture.
