景德镇陶瓷传统知识的传承遭到工业化的冲击,为了促进景德镇陶瓷传统知识的发展,对景德镇陶瓷传统知识保护的手段选择上,应当采取行政手段与民事手段并重的模式。通过行政手段保护可以使得景德镇陶瓷传统知识在现代社会得以保存;在民事手段保护选择上,可以通过知识产权制度某些细节、规则的修改完成对传统知识的充分保护,或者在知识产权法律中增加某些例外性规定实行对现行知识产权法某些具体规定的突破,实现景德镇陶瓷传统知识发展及合理化利用。

The inheritance of the traditional knowledge of Jingdezhen ceramics has been blocked by the modernization.In order to facilitate the expansion of the traditional knowledge of Jingdezhen ceramics,we should adopt administrative and civil means simultaneously.The traditional knowledge of Jingdezhen ceramics can still exist in our modern society under the protection through the administrative means.As for the choice of the protection through the civil means,we can achieve the absolute protection of the traditional knowledge by making amendments and alterations to the rules of intellectual property,or by adding some exceptional regulations to the specific clauses in the current law of intellectual property.In this way,we can proceed to develop and properly use the traditional knowledge of Jingdezhen ceramics.
