罪犯与性——以20世纪30年代罪犯性问题的争论为视角

Criminals and Sex——From the Angle of the Debate on Criminals' Sexual Problem in the 1930s

罪犯性问题是管理当局无法回避的问题。在传统中国,罪犯性问题只是在特定的时期或特定的环境下,才会引起统治者关注。20世纪30年代对此问题形成了两种不同观点。一种从人道主义出发,主张应解决罪犯性欲;另一种从激进主义角度,主张以优生学解决罪犯性问题。在和谐社会背景下我们必须正视和解决罪犯性问题与宽严相济刑事政策结合,通过完善相关法律制度,改善服刑人员人性待遇,体现罪犯改造的人性化。

The sexual problem of criminals is an issue that can not be neglected by the government.In ancient China,the problem of the sex of criminals caused the concern from the rulers only in a particular period or in particular circumstances.In the 1930s two different perspectives were formed concerning this problem.One of them is the humanitarianism view,which advocates the satisfaction of criminals＇ sexual desires;the other is from a radical point of view,advocating eugenics to solve criminals＇ sexual problem.In the context of a harmonious society we must face and solve the problem through the improvement of the relevant legal system and the treatment of prisoners in order to embody the human nature in the rehabilitation of criminals.
