摘要
商品化权是指权利人将自己的姓名、形象及创作的作品、角色、标志等通过商业化使用而取得经济利益的可能性的权利。我国现行知识产权立法因对影视虚拟角色及演艺明星商品化权保护缺失而带来的弊端日益显现。本文建议在我国增设商品化权制度,并从商品化权权利归属、权利构成要素、保护期限、侵权救济及权利限制等方面提出构建设想。
Merchandising right is a right which makes a profit.A celebrity uses his name,figure,production or a wel-known fictional character or sign in business circles and gets this right.As the China is short of the law of protecting virtual film roles and merchandising rights of the celebrity of film circles,the weakness in the protection of intellectual property of Film Company is becoming more and more prominent.This article suggests merchandising rights is to be added in our law,and gives some advice on final arrangement of right,basic ingredients,duration of protection,remedy for infringement and limitation on right.
